This training will examine asylum – covering both the legal standard and procedural best practices and trends – as well as related alternative forms of relief. After laying the foundation, we will focus on recent developments in asylum law, particularly in the context of DV and gang-based claims, after the precedential decision Matter of A-B- issued by the Attorney General in June 2018. Finally, participants will learn about procedure and regulations regarding credible fear interviews, as well as considerations for representing individuals in civil immigration detention. The training will conclude with a discussion about the Albany Detention Outreach Project which has mobilized to provide representation and counsel to hundreds of individuals recently transferred from the Southern border to the Albany County Jail.
CLE Credit: Approximately 5.5 credits in Areas of Professional Practice and 1.0 credits in Skills. This course provides transitional credit for newly admitted attorneys and non-transitional credit for experienced attorneys.
